The law protects you from dishonest insurance companies who routinely – and arbitrarily – underpay and deny valid claims. The State Insurance Code prohibits your insurance company from engaging in acts or practices in the business of insurance that are designed to harm consumers. Some of these unfair or deceptive acts include:


  • Misrepresenting facts or policy provisions relating to your coverage
  • Not attempting in good faith to promptly, fairly and equitably settling your claim
  • Not promptly giving you a reasonable explanation for the offer or denial of your claim
  • Not promptly affirming or denying coverage of your claim
  • Attempting to have you sign a release when only partial payment has been made
  • Refusing to pay your claim without conducting a reasonable investigation

The State Insurance Code allows you to bring suit against your insurance company – and even your adjusters – for any harm they have caused you by engaging in these, and other, deceptive acts and practices. The State Insurance Code also prohibits insurance companies and your agent from making false and misleading statements about your policy.
